This Privacy Policy explains how KLIXX DATE INC. (“KLIXX,” “we,” “us,” or “our”) collects, uses, discloses, and protects information about you when you use the KLIXX mobile application and any related websites or services we provide (collectively, the “Service”).

 

This Privacy Policy applies to information we collect:

 

•       When you create an account, build a profile, or otherwise provide information through the Service

•       When you communicate with other users through the Service

•       When you subscribe to paid features or make purchases through the Service

•       When you contact us, submit reports, or communicate with our support or safety team

•       When you visit our website or interact with our communications (if applicable)

 

This Privacy Policy does not apply to information collected by third parties, including Apple, Google, payment processors, or third-party websites or services you access through links in the Service. Their privacy practices are governed by their own policies.

 

By using the Service, you acknowledge that your information will be handled as described in this Privacy Policy. If you do not agree, do not use the Service.

 

1.     Information We Collect

 

We collect information in three ways: (1) information you provide to us, (2) information we collect automatically when you use the Service, and (3) information we receive from third parties.

 

1.1           Information You Provide to Us. When you create an account, build a profile, or use the Service, you may provide information such as:

 

(a)   Account and Profile Information. Name, email address, phone number, date of birth, profile photos, profile text, interests, and other information you choose to include in your profile. We do not share, sell, or disclose your personal information, including your email or mobile information to third parties for their promotional or marketing purposes.

(b)   Sensitive Profile Information. Information you choose to share about yourself, including gender identity, sexual orientation, relationship preferences, and similar personal information.

(c)    User Communications. Messages and other content you send to other users through the Service, as well as reports you submit and communications you send to our support or safety team.

(d)   Verification Information. If you choose to use verification features (such as photo verification), the information you submit for verification.

(e)   Marketing and Communications. If you sign up to receive emails or other communications from us, the information you provide and your communication preferences.

 

1.2           Information We Collect Automatically. When you use the Service, we may automatically collect information such as:

 

(a)   Device and Usage Information. IP address, device type, operating system, device identifiers, app activity, pages or features you view, interactions and engagement, and the dates and times you use the Service.

(b)   Analytics Information. Information collected through cookies, SDKs, pixels, or similar technologies is used to understand how the Service is used and to improve performance and functionality.

(c)    Location Information. General location information, such as city, and, if you enable location permissions, potentially more precise location information (such as GPS coordinates), depending on your device settings and how the Service is configured.

 

Where we request access to device features (such as location services, photos, or notifications), you can control whether you grant or revoke that access through your device settings and any in-app settings we make available. If you do not grant certain permissions, some Service features may not function properly.

 

1.3           Information We Receive From Third Parties. We may receive information from third parties, including:

 

(a)   App Store and Subscription Information. If you purchase a subscription through Apple or Google, we may receive information confirming your subscription status, purchase dates, and transaction identifiers, but we do not receive your full payment card details.

(b)   Service Providers. Information from vendors that help us operate the Service, such as hosting, analytics, customer support, and email service providers.

(c)    Third-Party Authentication. If you use third-party sign-in (such as Apple sign-in), we may receive information from that provider as needed to authenticate your account.

 

2.     How We Use Information

 

We use information we collect to operate, maintain, and improve the Service, and to support user safety and compliance. In particular, we may use information to:

 

(a)   Provide and operate the Service. Create and manage accounts, enable profiles, enable matching and discovery features, enable messaging, and provide other core functionality.

(b)   Support safety, trust, and moderation. Investigate reports, enforce our Terms of Service, prevent misuse, and protect the rights, safety, and property of KLIXX, our users, and others.

(c)    Process subscriptions and manage access to paid features. Confirm subscription status, administer paid features, and provide customer support related to billing (noting that purchases are processed through Apple or Google).

(d)   Communicate with you. Send administrative messages, security and safety notices, account updates, and respond to your requests.

(e)   Send marketing and promotional communications. Where permitted by applicable law, send marketing messages and promotional content, and honor opt-out requests.

(f)    Analyze and improve the Service. Understand usage trends, develop new features, measure performance, and troubleshoot issues.

(g)   Maintain security and prevent fraud. Detect, investigate, and prevent fraud, security incidents, and other harmful activity.

(h)   Comply with the law and enforce rights. Comply with legal obligations, respond to lawful requests, and protect our legal rights.

 

3.     How We Disclose Information

 

We may disclose information we collect in the following circumstances:

 

With service providers. We disclose information to vendors and service providers that perform services on our behalf, such as cloud hosting, analytics, customer support, email delivery, and security services. These providers are permitted to use information only to perform services for us and as otherwise required by applicable law.

(a)   With Apple and Google. If you make purchases through the Apple App Store or Google Play, Apple or Google will process your purchase and may share limited information with us, such as subscription status and transaction identifiers. Their handling of your information is governed by their own policies.

(b)   With other users. Information you choose to share through the Service may be visible to other users, including your profile information, profile photos, and messages. You are responsible for the information you share with others through the Service.

(c)    For safety, compliance, and enforcement. We may disclose information as reasonably necessary to investigate or respond to reports, enforce our Terms of Service, protect the rights, safety, and property of KLIXX, our users, and others, and to prevent fraud, security incidents, or other misuse.

(d)   For legal reasons. We may disclose information to comply with applicable law or legal process, to respond to lawful requests from public authorities (including law enforcement), and to protect our legal rights.

(e)   Business transfers. We may disclose information in connection with a corporate transaction, such as a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, including due diligence and transition planning.

(f)    With your consent. We may disclose information with your consent or at your direction.

 

We do not sell your personal information. If our practices change in the future, we will update this Privacy Policy.

 

4.     Sensitive Personal Information

 

Some of the information processed through the Service may be considered sensitive personal information, depending on how you use the Service and where you live. This can include information you choose to share in your profile or through your use of the Service, such as gender identity, sexual orientation, relationship preferences, and, where enabled, precise location information.

 

We use sensitive personal information for limited purposes, such as providing core Service functionality, supporting trust and safety and moderation, maintaining security, complying with law, and operating and improving the Service. We do not use sensitive personal information to infer characteristics about you beyond what you choose to share through the Service.

 

You can choose what information you share in your profile, and you can adjust certain permissions through your device settings, such as location permissions. If you choose not to provide certain information, some features of the Service may not be available.

 

5.     Cookies, Analytics, and Similar Technologies

 

We and our service providers may use cookies and similar technologies to collect information about how the Service is used. In a mobile app context, this typically includes software development kits (SDKs), device identifiers, log files, and similar technologies, and may include cookies in limited circumstances (such as on our website or within web-based components of the Service). 

 

These technologies may be used to:

 

(a)   Understand how users engage with the Service

(b)   Maintain and improve Service performance and functionality

(c)    Detect and prevent fraud, abuse, and security incidents

(d)   Support analytics and troubleshooting

 

5.1           Third-Party SDKs. Some of these technologies are provided by third parties (e.g., analytics, crash reporting, customer support, and similar services). These providers may collect information about your device and use of the Service in accordance with their own policies and our instructions. 

 

5.2           Tracking and Personalized Advertising. If we or our partners use data collected from the Service for “tracking” as defined by Apple (for example, linking data collected from the Service with third-party data for targeted advertising or advertising measurement), we will request any permissions required by your device platform before engaging in that activity. 

 

5.3           Your Choices. You can control certain data collection through your device settings and platform controls, including limiting ad tracking or resetting advertising identifiers where available, as well as through any in-app settings we make available. Some features of the Service may not function properly if you disable certain technologies. 

 

6.     Data Storage and Cross-Border Transfers

 

We store personal information using service providers and systems that may be located in Canada and other jurisdictions. Based on how the Service is configured, your personal information may be stored in Canada, including on cloud infrastructure provided by third-party hosting providers.

 

Because we operate and use service providers in multiple jurisdictions, your personal information may be accessed, processed, or stored outside of the province or country where you live. For example, personal information stored in Canada may be accessed by service providers or personnel located in the United States or other locations for support, security, analytics, and operational purposes.

 

When personal information is transferred, stored, or processed across borders, it may be subject to the laws of the jurisdiction where it is handled, and those laws may provide different privacy protections than the laws in your home jurisdiction.

 

We take reasonable steps to protect personal information when it is handled by service providers, including through contractual protections and appropriate safeguards.

 

7.     Data Retention

 

We retain personal information for as long as reasonably necessary to provide the Service and to fulfill the purposes described in this Privacy Policy. Retention periods may vary depending on the type of information, its use, and applicable legal, security, and operational requirements.

 

In general:

 

(a)   Account and profile information is retained while your account is active and may be retained for a period of time after account deletion to support safety, security, fraud prevention, and compliance obligations.

(b)   User communications and content (including messages) may remain available to other users to the extent shared with them. We may retain communications and related account activity as reasonably necessary for trust and safety investigations, dispute resolution, enforcement of our Terms of Service, and legal compliance.

(c)    Subscription and transaction-related information may be retained as needed for accounting, audit, customer support, and compliance purposes.

(d)   Usage and device data may be retained for analytics, security, and product improvement purposes, subject to reasonable retention limits.

 

If you delete your account, we will take reasonable steps to delete or de-identify personal information associated with your account, subject to legal and operational requirements and to the extent we are able to do so. We may retain certain information as reasonably necessary to comply with the law, enforce our agreements, protect our rights, and support trust and safety.

 

8.     Your Choices and Rights

 

You have choices about how your information is used and shared.

 

8.1           Account Information. You may review and update certain account and profile information through the Service.

 

8.2           Account Deletion. You may delete your account through the Service settings, where available. Deleting your account does not necessarily delete information that you shared with other users (such as messages) or information we must retain for legal, security, or operational reasons, as described in this Privacy Policy.

 

8.3           Location Controls. You can control location collection through your device settings and by granting or revoking location permissions.

 

8.4           Marketing Communications. Where permitted by applicable law, we may send you marketing or promotional emails or other communications. You can opt out of marketing emails at any time by using the unsubscribe link in the message or by contacting us.

 

We will process unsubscribe requests in accordance with applicable law. Even if you opt out of marketing messages, you may continue to receive administrative communications related to your account, safety, subscriptions, and operation of the Service.

 

If you provide your contact information to receive communications from us, you represent that you are authorized to provide that information and that it is accurate.

 

8.5           Device and Platform Controls. You may be able to control certain data collection through device settings and platform controls, such as limiting ad tracking where available.

 

8.6           Permissions. You can manage certain permissions through your device settings and any in-app settings we make available, including access to location services, photos, and notifications. If you disable permissions, some Service features may not function properly.

 

Depending on where you live, you may also have additional rights under applicable privacy laws. These rights may include the right to request access to, correction of, or deletion of certain personal information, and the right to object to or restrict certain processing. 9.     California Privacy Notice

 

This California Privacy Notice applies only to individuals who reside in California and use the Service.

 

9.1           Categories of Personal Information We Collect. In the past 12 months, we may have collected the categories of personal information described in this Privacy Policy, including identifiers (such as name and email address), personal information categories described in California law (such as date of birth), internet or other electronic network activity information (such as app activity and device identifiers), geolocation data (such as city and, where enabled, precise location), and sensitive personal information (such as sexual orientation, gender identity, and relationship preferences where you choose to provide it).

 

9.2           How We Use and Disclose Personal Information. We use and disclose personal information for the business and commercial purposes described in this Privacy Policy, including operating the Service, supporting safety and moderation, maintaining security, processing subscriptions, improving the Service, and complying with the law.

 

9.3           Sales and Sharing. We do not sell your personal information. We also do not share your personal information for cross-context behavioral advertising.

 

9.4           Your Rights and How to Submit Requests. Depending on applicable law, you may have the right to request access to, correction of, or deletion of certain personal information, and to receive information about our collection, use, and disclosure practices. 10.  Security

 

We take reasonable administrative, technical, and physical measures designed to protect personal information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction.

 

No method of transmission over the internet or method of electronic storage is completely secure. While we work to protect personal information, we cannot guarantee absolute security.

 

You are responsible for maintaining the confidentiality of your account credentials and for any activity under your account. If you believe your account has been compromised, you should notify us promptly.

 

11.  Children’s Privacy

 

The Service is intended only for adults aged 18 and older. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from someone under 18, we will take reasonable steps to delete that information.

 

If you believe a minor may be using the Service or that we may have collected information from a minor, please contact us using the information in the “Contact Us” section below.

 

12.  Changes to This Privacy Policy

 

We may update this Privacy Policy from time to time to reflect changes to the Service, our practices, or legal requirements. If we make changes, we will update the “Last Updated” date at the top of this Privacy Policy and may provide additional notice through the Service or by other reasonable means.

 

By continuing to use the Service after changes become effective, you acknowledge the updated Privacy Policy.
